Stamp Duty, or to give it it’s correct name, Stamp Duty Land Tax (SDLT) is arguably an optional tax. Like any tax planning, unless you do something about it, you’ll pay Stamp Duty when you buy a property costing more than £125,000.

Stamp Duty is raising billions for HRMC 

Stamp Duty is charged on land and property purchases. It’s paid to HMRC on the following scale:

  • Stamp Duty charged at 0% – up to £125,000
  • Stamp Duty charged at 1% – £125,000 to £250,000 (first time buyers pay 0%)
  • Stamp Duty charged at 3% – £250,000 to £500,000
  • Stamp Duty charged at 4% – £500,000 to £1m
  • Stamp Duty charged at 5% – Above £1m

But it’s an optional tax as you can see below.

Years of successful Stamp Duty planning

For many years, a number of specialist tax planners have used robust legal processes, backed up with tax Counsel’s opinion, to reduce or wipe out Stamp Duty altogether.

HMRC knows Stamp Duty planning goes on. But what you might be surprised to learn is that HMRC has a special form called SDLT1 which enables the tax planner to let the tax office know which Stamp Duty tax planning has been used. And this is part of its success – keeping HMRC fully informed so you can’t come a cropper at a later date.
